James Cann maintains an active litigation, trial, and dispute resolution practice at Koley Jessen. Businesses and individuals frequently look to him to take charge of the defense or prosecution of civil lawsuits filed in state and federal courts. His trial experience consists of numerous state and federal court jury cases tried successfully to a verdict and he has made several appearances in the Nebraska Supreme Court and Court of Appeals. His broad trial experience includes cases involving contract matters, negligence, fraud, product liability, insurance, probate matters, and real estate. He has represented taxpayers in TERC proceedings consistently for the past nine years.

Representative Experience

• Ten jury cases tried to verdict
• $1.3 million federal court jury award in complex commercial fraud and conspiracy trial
• $1.1 million federal trial court award in inverse condemnation case
• Successfully defeated class certification motion in nationwide class action lawsuit brought under federal statute governing facsimile communications
• Successfully defended estate’s personal representative against will contest action alleging undue influence by obtaining directed verdict during jury trial
• Several $1 million plus settlements
