Probate, Trust and Estate Administration

We recognize how difficult it is when a loved one passes away and we believe it to be a privilege to assist family members and beneficiaries with the administration and settlement of a decedent's estate. We encourage our clients to be involved at whatever level they are comfortable being involved. As the administration progresses, we will explain each step of the process so you are comfortable with what we are doing and why.

We will work with you very closely to obtain a complete inventory of assets, which is a requirement of the process. We believe that one of our strengths is the identification and positive resolution of complicated tax issues. We work closely with other advisors in the administration process such as accountants, appraisers and life insurance representatives. We will also consider and advise the survivors of post mortem planning opportunities. Our role is to ensure that the decedent's wishes are carried out as intended while, at the same time, incurring the least amount of tax and administration expenses. Most importantly, we strive to minimize the client's anxiety about this process which can seem overwhelming at such a difficult time.

What we can do for you:

Assist in the court supervised probate proceeding; prepare and file all necessary notices and pleadings in a timely manner
Assist in confirming ownership of assets and preparation of the inventory
Assist with post-death administration of non-probate assets and implementation of probate avoidance arrangements
Assist in arranging for and coordinating the valuation of difficult to value assets such as commercial real estate, farmland and closely held businesses
Prepare state and federal estate tax returns and state inheritance tax returns
Prepare tax analysis to ensure that expenses and deductions are utilized to minimize taxes
Work with your accountant in the preparation of the state and federal fiduciary income tax returns
Represent estates, trusts and beneficiaries in connection with tax disputes with the IRS and state taxing authorities
Consider and advise regarding post-mortem planning opportunities to minimize estate and income taxes for the current and future generations
Assist in distributing assets to beneficiaries, which may include the preparation of deeds, bills of sale and other documents for transferring ownership
