Everything You Need to Know About Good Faith Estimates | 45 minutes
A Deep Dive Into the Protections for Uninsured and Self-Pay Individuals Under the No Surprises Act

The requirements surrounding “Good Faith Estimates” apply to all providers and facilities in the health care industry. Most coverage of the No Surprises Act has focused on the balance billing prohibitions. However, some of the most onerous requirements surround the new protections available to uninsured and self-pay individuals. It is critical for providers and facilities to have appropriate procedures in place to address these requirements. Jake will discuss everything we know (so far) about this part of the No Surprises Act including, among other things, when to deliver Good Faith Estimates, the content of Good Faith Estimates, the purpose behind such protections, and current enforcement.

An influx in market capital has led to innovative models of integrated care that lead to better patient outcomes, lower health care costs, and an overall better experience for both patients and providers. Gretchen will provide an overview of the key considerations for integrating behavioral health into your health care practice. Gretchen’s presentation will discuss the basics of behavioral health integration, the processes by which behavioral health services can be integrated into physical health care settings, and the key legal considerations for integrated health care practices.

Medical Records - Maintenance, Retention, and Destruction | 30 minutes

Timely and accurate medical record maintenance is more important than ever. Medical records are the lifeblood of the practice when it comes time for a billing or compliance audit, or a malpractice action. First, Rick will review general information with regard to medical record documentation and retention requirements; more specifically, discussing documentation issues, what exactly should be retained in the medical record, how long medical records should be retained, and the real questions about medical records received from other providers. Next, Rick will discuss the interrelationship between medical record maintenance and HIPAA, specifically discussing when records “must” be disclosed or “may” be disclosed (including responses to subpoenas) and whether fees can be charged for the process. Finally, Rick will discuss the pros and cons of medical record destruction.

This presentation will discuss the cyber threats that the Omaha Cyber Task Force is seeing, including investigations they are working on. Schmutz will also discuss ways in which people and companies can better protect themselves.

Nebraska DHHS Investigations: Medicaid Audits and Unprofessional Conduct | 45 minutes

Regulatory enforcement in the health care space continues to be on the rise. A negative outcome in a Medicaid claims audit or licensure investigation can be devastating, both financially and professionally. Govern yourself and your practice accordingly. Joe will provide an overview of the Nebraska Medicaid False Claims Act and Nebraska unprofessional conduct rules as they apply to licensed healthcare providers, as well as the Nebraska DHHS investigation processes that apply to both. Using real-world examples, Joe’s presentation will provide guidance on what to do (and what not to do) when the medical practice (or provider) receives notice of a claims audit (overpayment review) or license disciplinary investigation, what notifications are required, what to expect, and how to navigate the process.

Rick will provide an update on various developments in the health law industry, including practicing post-covid, cyber liability risks, 1557 updates, new developments related to anti-trust enforcement, new developments related to confidentiality and nondisclosure provisions in employee handbooks, employment agreements and severance agreements, and new protections for pregnant employees.
