HIPAA Responds to Dobbs: Ensuring Compliance with the HIPAA Privacy Rule to Support Reproductive Health Care Privacy | 30 minutes

On April 22, 2024, the U.S. Department of Health and Human Services Office for Civil Rights (OCR) issued the HIPAA Privacy Rule to Support Reproductive Health Care Privacy in an effort to protect reproductive health privacy in the wake of Dobbs v. Jackson Women’s Health Organization. This rule marks the first time in over a decade that OCR has made substantive changes to the HIPAA Privacy Rule. In this presentation, Gretchen will provide a comprehensive analysis of the new rule, offer practical guidance for complying with the updated HIPAA requirements, and discuss the future of the rule under a new federal administration.

HIPAA Security Rule Overhaul | 45 minutes

Although the frequency of cyberattacks affecting the health care industry has surged in recent years, the HIPAA Security Rule has remained unchanged for over a decade. In response to such developments, proposed rulemaking to modify the existing Security Rule has been introduced to address these vulnerabilities through more robust cybersecurity protections for electronic PHI. This presentation will dive into the proposed changes and demonstrate how Covered Entities and Business Associates should begin evaluating their current cybersecurity practices to be prepared for future HIPAA compliance.

Stark Law: The In-Office Ancillary Services Exception | 30 minutes

For physician-owned medical practices, the in-office ancillary services exception is one of the most important and most widely used provisions of the Stark Law, but there are many conditions that must be met in order for it to apply. In this segment, Joe Huigens will discuss those conditions and issues that medical practices need to be cognizant of when furnishing DHS items and services for patients.

This session covers key legal requirements for managing employee time off, including the FMLA, ADA, and the new Nebraska Healthy Families and Workplaces Act taking effect in the fall of 2025. Learn best practices to stay compliant, minimize risk, and keep your workforce running smoothly.

Hiring and Termination of Employees in the Health Care Industry | 40 minutes
Richard D. Vroman and Erin E. Schroeder
Rick and Erin will discuss unique hiring and termination considerations with employees in the health care industry, focusing on background checks, licensing matters, and exclusion list review for hiring, as well as potential reporting obligations in the event of termination. Rick and Erin will also discuss the difficulties of discipline and/or termination of employees for performance, including discussions of the increased complexity of disciplining or terminating employees on job protected leave, such as FMLA, ADA, or other leave protection laws. The presentation will include discussion of various situations of leave abuse and ways to address the same, as well as best practices to avoid claims of retaliation.

Professional corporation bylaws, LLC operating agreements, shares of stock and membership units, annual meetings, consent minutes, amending the governing documents, et cetera et cetera. There are a lot of basic business organizational and governance topics that the modern medical practice administrator is expected to understand and guide the physician owners on. In this segment, Joe Huigens will provide a “101” level discussion of corporate formalities and governance topics that regularly come up in practice.

Responding to Patient Complaints and Unruly Patients | 30 minutes

Patients have the right to submit complaints to the medical practice. Sometimes related to HIPAA, sometimes because of disappointing service, and sometimes because they may have a legal claim. Other times, the practice has a reason to end its relationship with the patient. In this segment, Joe Huigens and Gretchen Lusso discuss various scenarios related to patient complaints and what to consider when responding to them.
