Hiring and Termination of Employees in the Health Care Industry
Rick and Erin will discuss unique hiring and termination considerations with employees in the health care industry, focusing on background checks, licensing matters, and exclusion list review for hiring, as well as potential reporting obligations in the event of termination. Rick and Erin will also discuss the difficulties of discipline and/or termination of employees for performance, including discussions of the increased complexity of disciplining or terminating employees on job protected leave, such as FMLA, ADA, or other leave protection laws. The presentation will include discussion of various situations of leave abuse and ways to address the same, as well as best practices to avoid claims of retaliation.
