Building a Compliant Website in the Healthcare Industry| 45 minutes

A compliant website in today’s online environment requires numerous descriptions, attestations, and details surrounding a business’s practices. These requirements stem from various corners of the law including, but not limited to, HIPAA, Americans with Disabilities Act, No Surprises Act, Transparency in Coverage Rules, and Federal Trade Commission guidance. While these federal laws mandate certain website disclosures, some states require additional descriptions of how a business processes personal information and data through its website. Jake will discuss what a compliant website needs to look like in the healthcare industry. It will include highlights on applicable laws, privacy policy drafting, good practices for building and maintaining such websites, and the consequences for failing to do so.

Building an Effective Health Care Compliance Program | 45 minutes

In November 2023, the U.S. Department of Health and Human Services Office of the Inspector General (OIG) issued its General Compliance Program Guidance as a tool for all individuals and entities involved in the healthcare industry to utilize when developing or updating their healthcare compliance programs. Earlier that year, the U.S. Department of Justice (DOJ) issued its updated Evaluation of Corporate Compliance Programs as a guide for prosecutors to use when evaluating the effectiveness of compliance programs. In this presentation, Gretchen will discuss how healthcare providers and industry participants of all sizes can utilize recent OIG and DOJ guidance to develop, create, or improve their healthcare compliance programs. Gretchen’s presentation will include a discussion of OIG’s and DOJ’s approaches to compliance, including the factors each consider when determining the effectiveness of a compliance program.

We are seeing an uptick in requests for information related to emotional support and service animals. Rick will explain the differences between emotional support and service animals. Rick will also discuss what you need to be thinking about when confronted with a request to bring an emotional support or service animal into the office from the view of both an employer and as a public accommodation. Finally, Rick will discuss the legal and practical implications your office may face if the doctor is asked to write a letter recommending an emotional support animal for a patient.

Join Dan as he explores everything you need to know about subpoenas for records and testimony. Starting with a refresher on Nebraska law and moving to how the landscape has changed since Nebraska adopted its version of the Uniform Interstate Deposition and Civil Discovery Act.

A Deeper Look at HIPAA Compliance and Patient Rights | 45 minutes
Joseph E. Huigens
In this presentation, Joe goes beyond the basic elements of HIPAA to provide a more in-depth review of select topics, such as responding to patient requests to access or amend health information, patient privacy complaints, requests to restrict disclosures of health information, and responding to a potential security incident. Joe will also review common related issues, such as who is authorized to make decisions for a patient about health services and parental rights to adolescent patient medical records. Lastly, Joe will highlight some additional considerations for HIPAA compliance programs.

A lot changes in a year. Rick will provide an update on various developments in the health law industry, including updates and reminders related to The new Corporate Transparency Act; Information Blocking Rules and the proposed disincentives for Health Care Providers; Education Assistance, and Tuition Reimbursement Programs for recruitment and retention purposes.
