Department of Labor’s Revised Overtime Rule Teed Up for Final Agency Review
On March 14, 2016, the Office of Information and Regulatory Affairs ("OIRA") received the Department of Labor’s ("DOL") proposed revisions to the Fair Labor Standards Act’s overtime rules. Although the revisions have not been published and no changes to the overtime exemptions have been made yet, that could soon change. The OIRA’s review is anticipated to take anywhere from 30-90 days. If the OIRA approves the proposed rule (as it is expected to), the DOL will publish the final rule, which will become effective 60 days later (mid-to-late summer). Delays at the OIRA or DOL or congressional action to block the final rule could push back the release and effective dates.
