    2018 has marked a year of expansive changes in the realm of electronic data and eCommerce and their impact on intellectual property. For example, global data privacy regulations (GDPR) went into effect impacting many U.S.-based companies. States are implementing their own GDPR laws, which will affect many U.S. businesses. Federal laws were passed regarding the seizure of data both domestically and overseas.

    Mike Linder, Koley Jessen’s Environmental Practice leader, presented at an environmental conference in Washington D.C. on current trends in state and federal environmental regulations. The conference was held at the National Press Club and was sponsored by the Environmental Health, Safety, and Sustainability Management Roundtable (EHSS) on November 13 and 14, 2018. The presentation was titled “Emerging U.S. Environmental Regulatory Issues and the Federal-State Nexus” co-presented with  Nick Steinke of Tellevate Consulting. EHSS is a coalition of senior environmental executives from Fortune 1000 firms who meet twice per year to exchange information with a goal of improving company programs.

    The Affordable Care Act brought with it a litany of changes to group health plans, some for the good and some for the bad. Small employers in general have experienced continual rate increases as well as a myriad of regulatory complexity. What many small employers aren’t aware of is the ACA’s provisions allowing for Qualified Small Employer Health Reimbursement Arrangements that permit applicable small employer’s to reimburse employees for coverage they purchase individually.     The impact of the June 21, 2018 U.S. Supreme Court ruling in South Dakota v. Wayfair will be felt by nearly every retailer and consumer. Removing the limitation means that nearly all catalog, online, and remote sales will have sales taxes collected by the retailer to be remitted to the proper jurisdictions, at least in states that impose a sales tax. For consumers, this means that the taxes will be the same on purchases made in brick-and-mortar stores and those made online. For retailers, the impact is much larger.
