Overview

Environmental and natural resources law requires more than technical knowledge; it calls for practical problem-solving that keeps projects moving while respecting regulatory and environmental considerations. Kianna L. Moore advises businesses and organizations on environmental and natural resources matters with that balance in mind.

On a day-to-day basis, Kia provides practical guidance on issues that affect operations, transactions, long-term planning, and risk management. She works closely with clients to help them understand regulatory obligations, navigate compliance challenges, and make informed decisions in a highly regulated landscape.

A large portion of Kia's practice involves environmental due diligence in mergers and acquisitions and real estate transactions. She advises clients on identifying, allocating, and mitigating environmental risk, including compliance with All Appropriate Inquiries requirements, Phase I environmental site assessments, Limited Site Investigations ("Phase IIs"), and post-closing continuing obligations.

Kia's practice also focuses on environmental compliance, permitting, and regulatory counseling, with particular attention to managing and mitigating environmental liability. She advises clients on obligations and risk under key federal environmental statutes, including the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA), the Clean Water Act (CWA), and the Clean Air Act (CAA), as well as equivalent state environmental laws and programs.

Her environmental law experience includes: (i) advising clients on compliance with state extended producer responsibility rules and regulations; (ii) assistance with clean water act citizen lawsuits; (iii) acquisition and regulatory compliance for bulk petroleum storage companies; (iv) livestock regulation and permitting including negotiation of a Consent Order to allow construction and operation; (v) negotiation of hazardous waste violations (RCRA) for improper storage and management of hazardous waste; (vi) underground petroleum storage tank and cleanup fund reimbursement matters in Nebraska and beyond; (vii) remediation requirements and process for cleanup of sites.

She regularly works with industrial manufacturers and facilities, as well as land trusts and organizations involved in conservation easements, helping them address environmental risks while supporting operational and conservation goals. Recognizing that timing and responsiveness often matter in this area of the law, Kia prioritizes attentive, collaborative guidance that helps clients, plan, operate, and make decisions with a clear understanding of how those decisions affect both operations and stewardship priorities.
