Profile

Max Burbach works closely with real estate developers, owners, investors, landlords, and tenants in the acquisition, financing, development, sale and leasing of commercial, retail, office and industrial properties.  Max’s experience and practical approach enables him to efficiently negotiate and draft complex transaction documents and implement solutions “on the fly” to help clients resolve problems and achieve goals.

Max is a Fellow of the American College of Real Estate Lawyers and has been selected by his peers for inclusion in The Best Lawyers in America® 2011-2024 for his work in Banking and Finance Law and Real Estate Law. He is also listed in Chambers USA: America’s Leading Lawyers for Business (Chambers & Partners Publishing).

  • Representation of shopping center and mixed-use developers in site acquisition, ECRs, financing, leasing, pad site sales, and sale of projects
  • Representation of clients in build to suit and sale/leaseback transactions
  • Negotiation of industrial and office leases for national clients
  • Representation of borrowers in negotiating and finalizing commercial and real estate loans, work-outs, deed-in-lieu of foreclosure, forbearance agreements, and settlement of guaranty liabilities
  • Representation of landowners in negotiating leases and licenses with wind energy developers and cell tower developers
  • Negotiating and drafting condominium documents, operation and easement agreements, restrictive covenants, and easements
  • Representation of lenders in agricultural and commercial loans
  • Representation of lenders and borrowers in private financing transactions
