Privacy litigation is evolving rapidly as businesses face new risks arising from AI tools, website technologies, privacy policies, data-sharing practices, and cybersecurity representations. Plaintiffs are increasingly pursuing claims based on website tracking technologies, alleged privacy policy misstatements, "sale of data" allegations, and emerging theories under federal and state privacy laws. This session follows the life cycle of the privacy issues we know you are facing. From the business practices and public statements that create risk, to the demand letters, investigations, and lawsuits that follow. Attendees will receive an update on significant privacy and AI developments and will learn how organizations can better prepare for and respond to claims. The presentation will also address the attorney-client privilege and work-product issues that arise during investigations and litigation, including interactions with insurers, forensic firms, consultants, and outside counsel.

As AI tools become further embedded in day-to-day business and professional practice, courts, regulators, and licensing bodies are moving quickly to define the standards that govern their use. This update covers the evolving professional, legal, and regulatory landscape related to AI use by businesses and by legal and accounting professionals, including key case law, regulatory, and legislative developments from the past year. We will examine how bar associations, accounting bodies, and state and federal regulators are addressing AI-related duties of competence, candor, and supervision, along with notable court decisions involving AI-generated work product. The session will close with practical guidance for building firm-level AI use policies and navigating client disclosure and confidentiality issues as these standards continue to develop.

The Clauses That Didn't Exist Three Years Ago: Negotiating AI Terms in Technology Agreements | 45 minutes

Artificial intelligence has introduced a set of provisions that did not appear in most technology transaction commercial agreements just a few years ago. These include training data rights, output ownership, accuracy and model-drift commitments, and AI-specific indemnities, just to name a few. This session walks through examples of these clauses from the customer's side of the table, including how to allocate regulatory compliance obligations and why generic SaaS templates should not be carried over into AI use cases without tailoring.

As remote and hybrid work arrangements become permanent fixtures, employers are increasingly turning to monitoring technologies, from keystroke logging and screen capture to GPS tracking and AI driven productivity analytics, to oversee their workforce. But where is the line between legitimate business oversight and unlawful invasion of privacy?

Attendees will gain a practical framework for advising on employee surveillance programs. Topics will include the current patchwork of federal and state laws governing workplace monitoring, including notice and consent requirements, along with key risk areas involving personal devices, social media, and off-duty conduct. We'll also address special considerations for tracking remote and hybrid employees, and take a look at emerging AI and biometric monitoring tools and the legal questions they raise. Attendees will leave with practical guidance for auditing existing surveillance practices and counseling business clients on implementing compliant, defensible monitoring programs.

Numerous states have enacted noncompete-related legislation in recent years. We will highlight developments of particular relevance to employers, from Minnesota’s near-total ban to the expansion of employer-protections in Florida’s CHOICE Act. We will also provide a brief refresher on Nebraska's continued reliance on common-law reasonableness standards. Attendees will learn practical takeaways for drafting compliant restrictive covenants across multistate workforces and advising both employers on enforceability risk in this unsettled environment.

Trade Secrets: Recent Legal Developments & Strategies to Protect | 45 minutes

Trade secret disputes continue to rise as companies grapple with a more mobile workforce, expanded use of third-party vendors, and the growing role of AI tools in handling proprietary information. In this presentation, we will discuss recent case law and legal updates regarding trade secrets, including how courts are treating misappropriation claims involving departing employees, competitors, and evolving technology. We will also address current best practices for identifying, classifying, and protecting company trade secrets and proprietary information, from internal safeguards and access controls to confidentiality agreements with employees and vendors. Attendees will leave with practical strategies for strengthening trade secret protection programs and for responding quickly and effectively when misappropriation is suspected.

Counterfeit products, unauthorized sellers, and brand misuse are increasingly common across Amazon, TikTok Shop, Instagram, eBay, and other online marketplaces. This practical program will equip in-house counsel with a working knowledge of the trademark and copyright tools available to address online infringement, including platform-specific takedown procedures, brand protection programs, and common enforcement pitfalls. Attendees will learn why a proactive brand strategy that includes trademark registration, and the use of administrative measures available through the U.S. Patent and Trademark Office, can materially impact the success of online enforcement.

Protecting Continuity Through Transition: Succession Planning In-House Counsel Can Drive | 30 minutes

Succession planning in closely-held and family businesses is often treated as the owner's personal estate matter — handled quietly with outside counsel, disconnected from the company itself. But much of what actually protects continuity through a transition lives inside the company's own documents and relationships, where in-house counsel is best positioned to lead. This session focuses on the practical, company-side planning GC can own or drive: keeping governance and ownership documents transition-ready, pressure-testing the buy-sell, securing key non-family talent, building emergency authority for the unplanned exit, and coordinating cleanly with the owner's estate and tax counsel so the two plans don't work against each other.
