Mikaela Witherspoon understands the interplay of intellectual property, data privacy, and commercial law and utilizes her experience to help clients execute technology transactions that protect their rights and intellectual property, while also limiting liability and ensuring compliance with regulations.
Mikaela drafts and reviews a variety of contracts and agreements, including:
- software license agreements
- software distribution agreements
- software development agreements
- SaaS agreements
- database license agreements
- technology license agreements
- joint development agreements
- IT services agreements
Additionally, she counsels clients on various data privacy matters, including compliance with comprehensive privacy regulations such as the EU’s General Data Protection Regulation (GDPR) and the California Consumer Privacy Act of 2018 (CCPA), as well as targeted regulations such as the Illinois Biometric Information Privacy Act (BIPA). She ensures clients understand how the various state and international privacy laws apply to their agreements and helps them navigate consumer requests and record-keeping requirements. Clients turn to Mikaela for advice on new uses and transfers of data to ensure that they are not breaching privacy laws and are compliant with industry best practices.
